Programs for Students With Disabilities Under Section 504 of the Rehabilitation Act of 1973 And The Americans With Disabilities Act of 1990 And The Americans With Disabilities Act Amendments of 2008
Section 504 of the Rehabilitation Act of 1973 and the Americans with Disabilities Act of 1990 and its amendments prohibit discrimination against persons with a disability in any program receiving federal financial assistance. Section 504/ADA and its amendments defines a person with a disability as anyone who: has a mental or physical impairment which substantially limits one or more of a person's major life activities; has a record of physical or mental impairment; or is regarded as having a physical or mental impairment.
Schools have responsibilities to provide accommodations, modifications and necessary services for eligible individuals with disabilities.
USD #263 acknowledges its responsibility under Section 504/ADA and its amendments to avoid discrimination in policies and practices regarding students, patrons and personnel. No discrimination against any person with a disability shall knowingly be permitted in any program or practice within USD #263.
