Emergency Safety Intervention
An Emergency Safety Intervention (ESI) is the restraint and/or seclusion of a student. The law allows it when a student is at immediate risk of hurting themselves or someone else or is damaging property. Seclusion and restraint must only be used in an emergency. Schools must attempt less restrictive ways first. When this is not possible, the law may allow restraint and/or seclusion. The school must stop the seclusion or restraint as soon as the student is no longer a threat to themselves or others.
Mulvane Public Schools USD 263 has a written policy regarding Emergency Safety Intervention, which can be viewed here. Additional resources are available to help families understand ESI, including the Families Together ESI Resource, the Kansas Administrative Regulations, the Family Guide to the Use of ESI and Parental Rights (English), the Family Guide to the Use of ESI and Parental Rights (Spanish), the KSDE ESI Standards, the State Administrative Review Guide for Parents, the Review Process, and the State Board Administrative Review Request Form. KSDE also offers a Professional Development Series on ESI. If you want more information please visit the KSDE website relating to Emergency Safety Interventions.
ESI Concerns
If you have concerns about the use of restraint or seclusion with your child, you have several options.
Parents may: (1) request a meeting with school staff to discuss the incident by contacting the school principal; (2) file a written complaint with the local school board within 30 days of being notified of the incident; (3) if unsatisfied with the local board’s decision or if a decision is not made within 30 days, request an administrative review from the Kansas State Board of Education.
For concerns related to Mulvane USD 263, please contact Trista Cuthbertson, Assistant Superintendent of Educational Services, at 316-777-1102 or via email at tcuthbertson@usd263.org.
